I, Olen Nichols, hereinafter referred to as Seller, offer to
sell one female Toy Fox Terrier registered as Foxfire Lotta
Luv, hereinafter
referred to as Dog, on limited registration John and Joanne
Smith, hereinafter referred to as Buyer, for the sum
of $1,000.00. This Dog is in good health with no evidence of
illness to the best of the Seller's knowledge at the time of
sale. This Dog is sold as a pet and must be neutered within
one hundred twenty (120) days from the date of purchase.
Seller will retain registration papers until proof of
alteration is provided to Seller in writing. Buyer agrees to
neuter Dog per the terms of this agreement and to prevent Dog
from producing any puppies.
Buyer has 72 hours from the date of purchase to have Dog
examined by their veterinarian. If Dog is found to have a
debilitating congenital defect or any communicable disease by a
licensed veterinarian within that 72 hour time period, and said
veterinarian submits a written statement to the Seller, Seller
will replace Dog with one of equal value or greater
value if Buyer pays the
difference. Seller guarantees Dog against Legg-Perthes, Von
Willebrands Disease, and Progressive Retinal Atrophy for a
period of one (1) year from the date of sale. If Dog is found
to have any of the above-mentioned abnormalities within that
one (1) year time period by a licensed veterinarian, and a
veterinarian statement and proof of alteration are forwarded
to Seller, Seller will replace Dog with one of equal value or
greater value if Buyer pays the difference. Buyer may retain
possession of Dog.
If at any time Buyer is
unable to continue ownership of Dog, Buyer agrees to contact
Seller, prior to placement or sale of Dog. Seller retains
right to reclaim Dog should Buyer discontinue ownership. The
Dog may not be sold without the prior written consent of
Seller. Buyer also stipulates that Dog will receive quality
veterinary care and be a housepet. Dog shall also be
maintained on a premium quality natural diet such as Innova or
Solid Gold and is never to be
fed a chemical based diet, Science Diet or grocery store grade
food. The Buyer may at any time return Dog to Seller. All
shipping costs incurred are the responsibility of the Buyer.
Seller may also reclaim dog should buyer fail to keep him in
acceptable condition and should his health and welfare be at
risk.
Seller assumes no
responsibility for the Dog after leaving Seller's premises:
medical or veterinary expenses, or for any other reason not
stated above. Any breach of the Contract by Buyer will result
in ownership of Dog reverting immediately to Seller and Buyer
paying Seller liquidated damages in the amount of $3,500.00.
Buyer and Seller agree that California State Laws apply to this
contract and to have any dispute settled in a California Court
of Law. Buyer has read and fully understood the foregoing and
agrees to all parts and portions thereof constituting a legal
and binding agreement.

** Puppy will need
additional boosters 3/6/2002, 3/27/2002, and 4/17/2002 and a
rabies booster at approximately 9 months of age. Rabies
should ALWAYS be given intramuscularly in this breed to avoid
reaction or abscess. I don’t recommend giving it at a younger
age due to the occasional reaction in this breed. Check with
your veterinarian to see if a heartworm preventative is
necessary in your area. If so, use only Interceptor Heartworm
preventative. If fleas are a problem in your area, use
Advantage or Program Flea Preventative. We occasionally see
some skin sensitivity from Advantage. Also, NEVER feed
Science Diet - it simply doesn’t agree with this breed. If
you need recommendations for other foods feel free to give me
a call.
